On Friday, The supreme court of India denied to direct the CBI to file an FIR against Sonia Gandhi and her colleagues in the Agusta Westland Chopper scam.
The court also said that the scam is already being investigated and now it is up to CBI to decide whether it wants to file an FIR against Sonia Gandhi and her colleagues in the Rs. 3600 crore VVIP Chopper scam.
The supreme court was hearing the plea from ML sharma who is a lawyer by profession and wanted an FIR filed against Sonia Gandhi, Former Manmohan Singh and Ahmed Patel. In his petition, ML Sharma said the the CBI is not taking action against high profile politician. The name of Sonia Gandhi and her colleagues features in the verdict passed by the Italian court.
The court stated that the CBI has to take action on the scam on the based of evidence. On Friday, the supreme court refused to give the credence on the verdict of Italian’s court on the chopper scam. The court also said that Sharma can appeal again if CBI does not take action in future against the accused despite having evidence.
The Italians’ court said that Agusta hired middlemen and paid bribe to Indian politicians to make sure it got a deal of 12 Chopper. The name of Sonia Gandhi and her colleagues were in the verdict of Italian’s court.
ML Sharma, a lawyer said in his petition that In the verdict of Italian court, names of the Sonia Gandhi and her colleagues have been decided as accused because they have taken bribe and are involved in the helicopter deal. Therefore an FIR and further criminal action must be initiated against them. But due to political reason the government will not do the same and the matter will be thrown in the dustbin in coming period of time.
Last month, the supreme court issued a notice to Central Government and the CBI seeking response on whether the probe could be taken over the Bureau and given to a SIT that the it would constitute.
On Friday, Central Government replied to the notice that a SIT is looking into the case and that all the accused would be punished.
