Supreme Court quashes criminal proceedings against Indian Cricketer MS Dhoni

On Monday, The Supreme Court finally dismissed the year long against cricketer M S Dhoni for supposedly harming religious feelings by imitating as God on a circular cover.

A court headed by Justice Ranjan Gogoi gave the break to Dhoni after seeing that the trial session in Karnataka failed in gathering the cricketer without following the procedure of law.

Upon the matter the bench said,

“We hinder with the order of the High Court and quash the proceedings including the summoning order against the accused… we have taken note of the complaint and the offence alleged while passing this order”

On September 14, 2015, the Supreme Court had dismissed the proceedings against Dhoni on an accusation filed against him for portraying himself as Lord Vishnu on a manual cover page.

The court had also referred the proceedings of the order of Karnataka High Court which had rejected to postpone the proceedings against him. Dhoni had appealed for the Special Leave supplication against the Karnataka HC order.

The accusation, lodged by political activist Jayakumar Hiremath, had asserted that Dhoni was seen on the cover page of a magazine as Lord Vishnu, holding various things, containing a footwear in his hands.

Considering the complaint, the Additional Chief Metropolitan Magistrate (ACMM) had ordered the filing of a lawsuit against Dhoni under section 295 (harming or hurting or defiling place of worship with an intention to offend the religion of any class) along with section 34 (common intention) under the IPC. Later, the ACMM had declared summons to Dhoni to come before the court, challenging which he decided to move forward to the High Court.
