On Wednesday, The Oshiwara police is planning to serve a summon to Comedian and Actor Kapil Sharma to seek explanations on the illegal construction made by him under section 53(7) of the Maharashtra Regional Town Planning Act (MRTP), 1966.
The section 53(7) of (MRTP), 1966 deals with prosecuting flat owners for not complying with notices against illegal constructions. On Tuesday, the oshiwara police had searched Kapil Sharma at his residences in Goregaon but he was unavailable at his flat.
Subhash Kanvilkar who is the senior police inspector at Oshiwara police station said that we searched at his residence. But, he was unavailable. We are investigating into the allegations made against Sharma and will be collecting all the required evidences against him. Once he is traced, he will be given notice to appear for the police probe and asked to explain the facts on the charges leveled against him.
Subhash further said that the notice will be intimation that cases are registered against him and under what charges he has been registered. If he cooperate with the police investigation, then we will be no need to arrest him. The offence in which he has been booked is bailable at police stations.
Under the relevant section of the MRTP Act invites a jail term varying from one month to three years and a fine of Rs 2,000-Rs 5,000.
Another officer said that Once the probe is over, a final report will be presented to the court with all the evidences.
Sharma has been booked for illegal construction. Separate FIRs were filed against Sharma on Monday by Abhay Dinkar Jagtap (39), sub-engineer, Brihanmumbai Municipal Corporation (BMC) P/South ward for alleged unauthorised extensions in their flats on ninth floor in DLH Enclave in Goregaon.
