US H-1B Visa Process Begin Today; Toughest Selection

Well, reports are coming that filing petitions for H-1B H-1B Process have been started again. Now, you all may know that this is one of the most important things for the Indian professional who wants to immigrate on American with work visas. Sources are saying that the process begins on Monday amid unprecedented scrutiny by the Trump administration.

Overall, it is great news for the people who are seeking for the opportunities on various jobs and posts in America. The USCIS (the United States Citizenship and Immigration Services) will open its doors to the H-1B visa applications for the season 2018-19. Also, the applicants could easily work in the United States from October 1st 2018 during the tenure of the visa – which may be for an initial maximum period of three years.

Also, you all should know that the selection process isn’t going to be too easy now. This new policy was issued on March 23 but they made it public recently. The USCIS stated that in cases where multiple applications are filed by “related entities” (a parent company, a subsidiary, or even an affiliate) for the same visa seeker, there needs to be a legitimate business need otherwise the application will be rejected.

In the talk with our source, Kuldeep Singh, an immigration lawyer said, “ In the US federal law, a single company cannot file multiple H-1B applications + for the same visa applicant. When a company files an H-1B application, another related company cannot do so unless there exist two separate job opportunities. These jobs must be clearly different.”

You all may know that this selection process was stuck since very long time. Well, now, they opened it but made it pretty harder to clear, it will have absolutely zero tolerance for even minor errors in the application. Also, the sources are saying that many applications are going to be rejected from now because of the hard selection process.

Some of you may know that the H-1B is a non-immigrant visa that allows US firms to employ foreign workers in jobs that require theoretical or technical expertise. Also, The H1-B visa has an annual limit of 65,000 each financial year as mandated by the US Congress, their parliament. Well, they are more concerned about their people and things are going to be tougher in upcoming days.
